Conclusion of contract
By clicking the order button you confirm that you bindingly wish to purchase the chosen painting. Our offers are always subject to change without notice. If you should like to purchase more than one painting, we can grant you a discount on the total amount.
The acceptance of the contract from our side is effected with our order confirmation.
Prices
The mentioned prices are understood to be suggested sales prices including the valid VAT and excluding shipping costs.
Completion of contract and despatch
According the method of payment you have chosen with your order, the item with be shipped after 1 to 2 working days. In the case of payment per bank transfer, we usually have your package already prepared for shipping and can ship on the same day of receipt of payment.
Payment terms
The sales price must be paid before delivery of the painting. You can pay either per bank transfer (in advance) or with Paypal.
Billing and payment will be effected in Euros.
You will receive the details of the respective method of payment in our order confirmation, which you will receive per email.
Shipping costs
Depending on the price, the weight and the destination country, we shall deliver your order with pro-rated shipping charges for you. The shipping costs depend on the current DHL or Hermes prices. ( www.post.de , www.hermespaketshop.de )
The exact shipping costs are mentioned for the individual painting. If you wish to order an additional painting it will naturally be shipped at no extra cost per order.
Delivery
Delivery will be effected after receipt of payment, packaged very safely and securely and will include all necessary customs documentation with DHL or Hermes.
Please note that paintings on stretchers can only be shipped within the size limitations of the shipping companies.
Large paintings can be shipped as a rolled canvas (absolutely harmless for the paintings) world-wide for a very reasonable price and absolutely safely.
Delivery time
We ship the majority of orders within one, latest 2 days after receipt of payment. You will receive a confirmation of shipment per email from us.
Please take into consideration that after we have delivered the painting to the shipping company’s branch, we have no influence on the actual transit time.
Warranty/Liability
We assure that the painting offered is totally in our possession and free of any rights from third-parties. In addition, we assure that each painting is a unique work of art from us personally. Warranty claims are excluded for possible faults.
Unless otherwise stated, the statutory warranty periods apply.
Copyrights
All copyrights and other rights of exploitation use, such as rights of reproduction etc. rest with the artists.
Cancellation instruction
Should you for some reason not be satisfied with the painting, you have the right to return it within 14 days after receipt, in an unaltered condition and in the original packaging. In this case we commit ourselves to return the amount paid in full with the exception of the shipping costs. The deadline begins earliest with the date of receipt of the painting and this cancellation instruction. In order to meet the cancellation deadline, it suffices to return the painting punctually or the written demand for return. In any case, the return will be effected at the costs and risk of the customer.
Reservation of property rights
All paintings delivered to the customer remain in the possession of the artist until complete payment has been made and received.
Data privacy
All personal data will be handled with utmost confidentiality, will not be passed-on to third parties and stored only as long as necessary for completion of the contract.
Print/Data errors
We accept no responsibility for any print or data errors in our advertising or online mediums due to slight negligence.
Place of performance and jurisdiction
For these General Terms and Conditions, and the complete privity of contract between J&O Art Studio Cologne and the customer, It is agreed that the law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on contracts for the International Sale of Goods.
For all services and goods delivered, the place of fulfilment is deemed to be the domicile of the artists.
Place of jurisdiction, unless mandatory rules do not otherwise conflict, is the domicile of the artists.

Vertragsabschluss
Sie erklären durch Anklicken des Bestell-Buttons, die ausgewählten Gemälde verbindlich erwerben zu wollen. Unsere Angebote sind stets freibleibend. Wenn sie mehr als ein Gemälde kaufen möchten, wir machen Ihnen Rabat auf die gesamte Summe.
Die Vertragsannahme durch uns erfolgt durch die Bestätigung Ihrer Bestellung.
Preise
Die angegebene Preise verstehen sich als Vorschlagspreise incl. der aktuell geltenden MWSt. und exklusive Versandkosten.
Ausführung des Vertrages und Versand
Je nach Zahlungsart, die Sie während der Bestellung gewählt haben, wird Ihre Sendung nach 1 bis 2 Werktagen versendet, bei Zahlung per Überweisung haben wir Ihre Sendung im Versand meist schon vorbereitet und versenden noch am Tage des Zahlungseingangs.
Zahlungsbedingungen
Der Kaufpreis ist vor der Lieferung des Bildes zu entrichten. Sie können per Überweisung (Vorkasse) oder PayPal bezahlen.
Die Berechnung erfolgt in Euro.
Einzelheiten zu den jeweiligen Zahlungsarten erhalten Sie in der Bestellbestätigung, die wir Ihnen per E-Mail zuschicken.
Versandkosten
In Abhängigkeit vom Preis, dem Gewicht und dem Land, in das eine Bestellung geliefert werden soll, liefern wir Ihre Bestellungen mit einem Versandkostenanteil für Sie. Versandkosten richten sich nach den aktuellen DHL oder Hermes Preisen. ( www.post.de , www.hermespaketshop.de )
Die genauen Versandkosten sind jeweils bei dem einzelnen Gemälde angegeben. Für ein weiteres Gemälde berechnen wir selbstverständlich keine zusätzlichen Versandkosten.
Versand
Versand erfolgt nach Erhalt der Bezahlung sicher und aufwendig verpackt, ausgerüstet mit allen Zollformalitäten per DHL oder Hermes.
Bitte beachten Sie, dass Gemälde auf Keilrahmen nur bis Grösse, die Versanddienste bestimmen, können versenden werden.
Gerollt (vollkommen unschädlich für das Gemälde) lassen sich günstig und sicher auch grosse Bilder weltweit versenden.
Lieferzeit
Wir versenden den Großteil aller Bestellungen einen spätestens zwei Tage nach Ihrer Bestellung. Sie erhalten von uns eine Versandbestätigung per eMail zugeschickt.
Bedenken Sie, dass nachdem wir die Pakete in der Postfiliale abgegeben, wir haben keinen Einfluss auf die Versandzeit.
Gewährleistung
Wir versichern, dass sich derzu veräußernde Gemälde in unserem alleinigen Eigentum befindet und frei von Rechten Dritter ist. Wir versichern darüber hinaus, daß jedes Gemälde eine eigenständige Arbeit von uns ist. Gewährleistungsansprüche für etwaige Mängel sind ausgeschlossen.
Sofern nicht anders angegeben, gelten die gesetzlichen Gewährleistungsfristen.
Urheberrechte
Sämtliche Urheberrechte und weitere Nutzungsrechte wie auch die Reproduktions-Rechte obliegen den Künstlern.
Rückgabebelehrung
Sollten Sie mit dem Gemälde nicht zufrieden sein, sie haben das Recht Gemälde innerhalb von 14 Tage nach Erhalt, in unverändertem Zustand und in der Originalverpackung an uns zurücksenden. Wir verpflichten uns in diesem Fall die ganze Summe Ihnen erstatten, ausgenommen Versandkosten. Die Frist beginnt frühestens mit Erhalt der Ware und dieser Belehrung. Zur Wahrung der Frist genügt die rechtzeitige Absendung der Ware oder des Rücknahmeverlangens. In jedem Falle erfolgt die Rücksendung auf Kosten und Gefahr der Kunden.
Eigentumsvorbehalt
Alle den Kunden gelieferten Bilder bleiben bis zu vollständigen Bezahlung des Kaufpreises im Eigentum des Künstlers.
Datenschutz
Alle persönlichen Daten werden vertraulich behandelt, nicht an Dritte weitergegeben und nur so lange gespeichert als sie zur Erfüllung des Auftrages nötig sind.
Druckfehler/Datenfehler
Für eventuelle auf leichter Fahrlässigkeit beruhende Druckfehler in unseren Werbemitteln und Datenfehler in unserem Online-Shop übernehmen wir keine Haftung.
Erfüllungsort und Gerichtsstand
Für diese Geschäftsbedingungen und die gesamten Rechtsbeziehungen zwischen J&O Art Studio Cologne und dem Käufer gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.
Für alle Leistungen ist Erfüllungsort der Wohnort der Künstler.
Gerichtsstand ist, soweit nicht zwingendes Recht entgegensteht, beim Wohnsitz der Künstler
